This constitutes a binding agreement (“Terms” or “Agreement”) between you and The 18629 LLC dba The Maven Store and its affiliated companies (“The Maven Store,” “us,” “we,” or the “Company”).

These Terms apply to all services provided by The Maven Store (“Services”), including digital services provided through the website located at www.themavenstoreca.com (the “Site”) and electronic communications sent to you by The Maven Store or its partners.

By using The Maven Store Services, you signify that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not use the Company’s Services, including its Site.

PLEASE READ THESE TERMS OF USE CAREFULLY. THESE TERMS INCLUDE AN AGREEMENT TO MANDATORY ARBITRATION, WHICH MEANS THAT YOU AGREE TO SUBMIT ANY DISPUTE RELATED TO YOUR USE OF THE COMPANY’S SERVICES TO BINDING INDIVIDUAL ARBITRATION RATHER THAN PROCEED IN COURT. THIS AGREEMENT ALSO INCLUDES A CLASS ACTION WAIVER AND A JURY WAIVER.

By using the Company’s Services, you agree to be bound by the Company’s Privacy Policy, which is expressly incorporated into this Agreement by reference.

NO USE OF THE SERVICES BY PERSONS UNDER 21

Our Services are intended for a mature audience. Only persons who are 21 years or older may use the Services.

By using the Services, you represent that you are at least 21 years old and legally able to enter into this Agreement.

Cannabis Disclaimer

Cannabis is a Schedule I Controlled Substance under the Controlled Substances Act (21 U.S.C. § 802), and the cultivation, distribution, and possession of cannabis is a crime under federal law.

Keep all cannabis and cannabis products out of reach of children and animals. Intoxicating effects may be delayed up to two (2) hours. Use of cannabis while pregnant or breastfeeding may be harmful. Consumption of cannabis impairs your ability to drive and operate machinery.

Acknowledgment of Federal Law

The Maven Store operates under applicable state laws. You expressly acknowledge that marijuana is listed on Schedule I of the United States Controlled Substances Act and that manufacturing, distributing, dispensing, or possessing cannabis is illegal under federal law.

Health Information

Statements relating to cannabis goods or products available on the Services have not been evaluated by the FDA. Products available on the Services are not intended to diagnose, treat, cure, mitigate, or prevent any medical condition or disease.

USER ACCOUNTS

You must create an account to use some features of the Services. Account registration requires personal information including your name, phone number, email address, date of birth, or government-issued ID.

You agree to maintain accurate, complete, and up-to-date information in your Account. Accounts are limited to one per person.

You are entirely responsible for maintaining the confidentiality of your password and all activity that occurs on your account.

AGE RESTRICTIONS

You must be at least 21 years old to purchase adult-use cannabis through the Services.

By using the Services, you represent that you are at least 21 years old and legally entitled to enter into this Agreement.

PRODUCT PURCHASES, BILLING, AND PAYMENT

All sales are final, non-cancelable, and non-refundable except as otherwise determined by us in our sole discretion.

All prices are in United States dollars and are subject to change without notice.

You are responsible for paying any applicable sales or use tax or other governmental fees payable in connection with products you purchase.

USER CONTENT

If you send or post content to The Maven Store or its Services, including photos, messages, or commentary, you grant The Maven Store a perpetual, worldwide license to copy, distribute, transmit, publicly display, reproduce, edit, translate, sell, transfer, or reformat your content without limitation, notice, or compensation to you.

With respect to your use of the Services, you agree you will not:

THE MAVEN STORE’S SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

LIMITED LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATED ENTITIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

GOVERNING LAW AND ARBITRATION

These Terms of Use shall be governed by the laws of the United States and the State of California.

Except for disputes brought in small claims court, all disputes shall be determined by arbitration in the County and City of Los Angeles, California, before one arbitrator, administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.

IF YOU ARE A NEW USER, YOU CAN REJECT THE AGREEMENT TO ARBITRATE BY EMAILING AN OPT-OUT NOTICE TO help@mavenmvn.com NO LATER THAN THIRTY (30) DAYS AFTER THE DATE YOU FIRST SIGNED UP FOR SERVICES.

CLASS ACTION WAIVER

Any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action.

MODIFICATIONS

The Company may revise these Terms of Use, modify the Site and/or other Services, or discontinue the Site and/or Services at any time in its sole discretion.

Any revision shall be effective immediately upon posting. Your continued use of the Site following any revision constitutes your agreement to abide by such revision.

SEVERABILITY

If any part of this Agreement is found by a court to be invalid, illegal, or unenforceable, the rest of the Agreement will remain in effect.

ANY CLAIMS ABOUT CANNABIS OR ANY MAVEN STORE PRODUCT HAVE NOT BEEN REVIEWED BY THE FDA. MAVEN STORE PRODUCTS ARE NOT INTENDED TO DIAGNOSE, CURE, OR PREVENT ANY DISEASE OR ILLNESS.
